Federal Supreme Court Invalidates Decision Hindering Foreign Investment in Iraq

The Federal Supreme Court issued a ruling today, Tuesday, declaring unconstitutional a decision by the dissolved Revolutionary Command Council that halted the enforcement of laws permitting non-Iraqis to own and invest their funds in companies within Iraq. The court stated in a release that the session was held under the presidency of Judge Mundhir Ibrahim Hussein with the attendance of all members. The court examined a lawsuit filed by the Prime Minister and the Speaker of the Parliament in their official capacities, requesting the invalidation of decision number (23) of 1994, amended by decision number (33) of 1997, issued by the dissolved Revolutionary Command Council. The contested decision suspended the application of laws and decrees allowing non-Iraqis to own companies or invest their money inside Iraq, imposing prison sentences ranging from one to three years on violators, and up to two years for Iraqis, along with confiscation of unlawfully acquired assets. The court noted that the ruling of unconstitutionality was based on violations of articles from the 2005 Iraqi Constitution, emphasizing that the decision is binding on all authorities according to Article (94) of the Constitution, and it was publicly announced.
