The Supreme Judicial Council issued strict directives today, Thursday, on enforcing laws against encroachment on public road easements and causing damage. This measure aims to bolster the protection of national infrastructure and public utility areas. These directives emerged from the Council's tenth session held this morning, presided over by the President of the Federal Court of Cassation, Judge Faiq Zidan. The session also included a tribute to the late Deputy Public Prosecutor in Diyala, Ahmed Mahmoud Abd, and the late retired Judge Sabah Nouri Nasser. Furthermore, the Council approved promotions for several judges and public prosecutors, reviewed transfers, granted judicial positions, and adopted judicial formations aligned with public interest. During its deliberations, the Council reviewed a communication from the Baghdad Municipality regarding encroachments on public road easements and designated public utility spaces. Subsequently, specialized investigative courts were instructed to implement rigorous legal actions. This includes ensuring the application of the crime of encroachment on public road easements and causing damage, under Public Roads Law No. (35) of 2002, alongside penalties specified in the Iraqi Penal Code No. (111) of 1969 for violations concerning public roads and facilities. To guarantee the smooth execution of service projects, the Judicial Council also stressed tightening legal measures against assaults on Baghdad Municipality staff, particularly during their implementation and rehabilitation of these crucial projects, in accordance with Articles (229) and (230) of the Iraqi Penal Code.
